Pedestrian accident results in death in Iowa

As a pedestrian in Iowa, you have the right of way any time you're crossing the road, according to state law. Drivers must yield to you, and if they don't, they're at risk of getting ticketed or facing additional charges. If you've been struck by a vehicle, you have the right to seek damages in this state.

The family of this woman may choose to seek charges, too. The woman was killed in an accident that took place at the intersection of Hickman Road and 40th Street in Des Moines, Iowa. The police on scene reported that a Chevy Astro van that was traveling west on Hickman Road struck a 57-year-old woman who was crossing the road at around 9 p.m. It's not clear if the time of day contributed to her death.

In Iowa, drivers can be ticketed for failing to yield to pedestrians, and pedestrians may have a case against drivers if they're hit by a car. Although police do not believe that the driver was speeding or impaired, it's required by law for drivers to give pedestrians the right of way in any situation, marked or unmarked.

According to the report, the 26-year-old man came upon the woman quickly, but she did have time to try to get out of the way. Unfortunately, she jumped in the same direction he swerved. She was taken to Iowa Methodist Medical center for her injuries, but she later died. Police reported that the man had tried to swerve to avoid the woman; they believe he didn't see her crossing.

Police are still investigating this crash. They haven't pressed any charges yet, but they could choose to do so following their investigation.
