Is a personal injury claim affected by personal medical coverage?

You were driving down the street when you were suddenly hit by another motorist. Now, you've been left with injuries that required you to pay for massive medical bills. Fortunately, your health insurance covered most of those expenses, so there's only a small amount to make up with a claim. Should you claim for the full amount, or should you only ask for the remaining costs? Will your claim be affected if you receive health insurance coverage from your own carrier or if you get paid sick time from work to help cover your lost wages?

Does your claim get reduced if you get paid sick time or health coverage?

No, and in fact, those bits of compensation aren't even relevant to your case. The only thing that is important to know about taking your own health insurance compensation is that your carrier may want you to reimburse it, since the accident wasn't your fault and you could be awarded compensation.

You may not need to reimburse all fees or medical expenses that were covered, but it's wise to talk to your attorney and health insurance carrier before you accept coverage.

With paid sick time, you'll be receiving pay for the time you missed from work, but it's unlikely that all your missed days will be covered. Even if they are, your employer may want to be reimbursed due to the nature of your injuries and the case, which is possible if you include this in your claim.

In any situation where you're facing injuries, negotiating a fair and comprehensive settlement is important. Gathering information on the costs you need to reimburse and the costs you'll have in the future for your medical care can help make that happen.
