Woman sues Department of Transportation over husband's death

It's not often that you're able to sue the government for the death of someone you love who was in a one-vehicle collision. However, in this case, the Iowa Supreme Court has ruled that a woman can sue the Transportation Department for her husband's death. Her husband died on Highway 69 in Warren County when he wrecked his motorcycle.

The woman claims that the April 2012 accident took place because of the negligent maintenance of the highway. Following his death, she filed a claim with the state's appeal board explaining that she felt the Department of Transportation had not been taking care of the highway and that the neglect of the road led to his crash.

The woman was not answered by the appeal board for over six months, which forced her to file another lawsuit in the district court. There, her case was again thrown out, but now, the Iowa Supreme Court agrees she can file a claim against the Department of Transportation. Although the Court of Appeals claims the woman never stated she was the administrator of her husband's estate, the Iowa Supreme Court found that she could sue and should have been able to in the past.

This case is a prime example of why filing paperwork with a court properly is so important. Simple wording mistakes or missing information can delay a case, and court administrators can choose to ignore cases that don't seem to be filed correctly. Once paperwork is filed correctly, a court should be able to help you with your case, just like this woman will finally be able to have hers heard.
