Pedestrian in critical condition following accident in the rain

When people drive at night, they need to be particularly careful about watching for pedestrians. Not all pedestrians are going to be easy to see; some may be in crosswalks in dark clothing or be on sidewalks without reflective outfits, but that doesn't excuse drivers who strike them. When a pedestrian is in a crosswalk or on a sidewalk, he or she should be safe; speeding or negligent drivers need to be aware of their surroundings.

Pedestrian accidents can cause serious injuries, and if you've been in one, you may already be talking to your attorney about your options. That's what this woman or her family may want to do, because she nearly lost her life when she was struck by a vehicle. A story from Dec. 14 states that the 64-year-old woman from Council Bluffs, Iowa, was walking across the roadway with another person when a driver approached.

The driver was a 66-year-old woman from Omaha who reported that she had just stopped at a traffic light at South 24th Street. She was driving north when she approached the couple. She spoke to police and informed them that the weather was poor; it was raining and she claimed to have poor visibility. Still, she had time to swerve to avoid a man in the road, but that action caused her to strike the woman next to him.

The driver claims she couldn't see the people because of the weather and because they were wearing darker clothing. The police haven't reported if any charges are being filed, but they have said that the victim suffered a broken leg, minor bleed on the brain, cuts, scrapes and broken ribs.
